Dismissing Underperforming Employees in Compliance with Chinese Labor Law

China's new Labor Contract Law (LCL), which became effective on Jan. 1, 2008, emphasizes employee rights, but employers in China are not without recourse when it comes to underperforming employees. Nonetheless, employers should make efforts to remedy underperformance before taking more drastic measures. In China's fast developing labor market, employees are increasingly aware of their rights.
